MEMORANDUM OF UNDERSTANDING FOR PERSONNEL TRAINING
BETWEEN
THE MINISTRY OF EDUCATION OF THE PEOPLE'S REPUBLIC OF CHINA
AND
THE NATIONAL RESEARCH COUNCIL OF CANADA
The Ministry of Education of the People's Republic of China (MOE) and the National Research Council of Canada (NRC) intend to collaborate on a joint training program for Chinese PhD students and post-doctoral fellows who wish to carry out research projects at the National Research Council as part of their doctoral studies or post-doctoral research
MOE and NRC (hereinafter referred to as "the Parties") have discussed an enhanced scientific collaboration and exchange of personnel and expressed their intention to cooperate in the future;
Now therefore, based on principles of trust, equality and mutual benefit, the Parties have reached the following understanding:
1 GENERAL PROVISIONS
1.1 The Parties will facilitate exchanges of NRC experts with researchers and graduate students of Chinese Universities and Research Institutions affiliated to MOE, and provide each other with opportunities to exchange scientific information;
1.2 The parties will foster scientific collaboration and promote mutually beneficial joint projects among NRC researchers and Chinese Universities and Research Institutions affiliated to MOE such as the publication of studies and reports.
2. FORMS OF COLLABORATION
The subject areas of research eligible for this Memorandum of Understanding (MOU) will be those areas of science and technology that fall within the current NRC program activities in the institutes as described in the NRC website at www.nrc-cnrc.gc.ca
The Parties envisage the following forms of collaboration under this MOU:
a) The promotion of the exchange and training scientific and technical personnel and students. In addition, NRC will send its experts to China to give lectures and do research at Chinese Universities and Research Institutions affiliated to MOE, and the Chinese Universities and Research Institutions affiliated to MOE will send researchers and graduate students to do research and pursue further training and studies with NRC;
b) The co-supervision of graduate students in Chinese Universities and Research Institutions affiliated to MOE by giving lectures and guidance on research and academic paper writing;
3. CONTRIBUTIONS BY THE PARTIES:
The parties will co-sponsor up to twenty (20) Chinese PhD research students and postdoctoral Fellows each year.
NRC will contribute by covering the expenses related to the salaried-time spent by supervisors, laboratory materials, and arrangement of proper office space and supplies at NRC.
MOE will contribute by covering one round-trip airfare, living expenses（including health insurance）during their stay at NRC.
4. IMPLEMENTATION AND COORDINATION
This MOU will be managed through a steering committee composed of representatives of each of the Parties. The steering committee will consist of the President, Vice Presidents and the Director of International Relations Office at NRC and designated representatives of the Department of International Cooperation and Exchanges of MOE and its designated executive agency, i.e. the Secretariat of China Scholarship Council.
The steering Committee will meet periodically, at times and places of its choice, to review progress and recommend areas for collaboration and projects, identify possible sources of project funding, as appropriate, and coordinate administrative matters.
The Implementation Plan for MOE-NRC Research and Post-doctoral Fellowship Program will be as attached in Annex 1 of this MOU.
5. INTELLECTUAL PROPERTY
Should activities within the scope of this MOU lead to the creation of commercial intellectual property, the Parties will decide in advance in collaborative contracts as to the ownership and disposition of those rights.
6. COMING INTO EFFECT AND DURATION
This MOU will come into effect on the date of signing and will remain in effect for a period of four (4) years. It may be extended upon mutual written consent of the Parties.
This MOU may be amended at any time by mutual written consent of the Parties. Any Participant may terminate this MOU by giving the other Participant a written notice ninety (90) days in advance of its decision to terminate this MOU.
Termination will not affect activities covered by a collaborative contract between the Parties and already underway at the time of termination.
7. CONFLICT RESOLUTION
This MOU is a good will arrangement which reflects the current understanding of each of the Parties with respect to the matters described herein, and does not create legally binding obligations under international law or under the Parties' domestic law.
Any conflict arising out of the interpretation or implementation of this MOU will be settled amicably by the Parties by consultation and will not be referred to any court or tribunal.
This Memorandum of Understanding shall be effective as of January 15, 2007. SIGNED in duplicate in the English, French and Chinese languages, each version being equally valid.

Annex 1
Implementation Plan for
MOE-NRC PhD Research and Post-doctoral Fellowship Program
Preliminary Eligibility for applying Chinese Government Scholarships
• PhD research students (for joint PhD program)
1. no more than 35 years old at the time of application
2. full-time PhD students of Chinese universities or research institute
3. intention of stay in Canada between 6-24 months
• Post-doctoral fellow
1. no more than 40 years old at the time of application
2. completed a PhD within the past 3 years at the time of application
3. intentions of stay in Canada between 3-12 months
Application requirement of NRC
1. For each Ph.D. research student applicant, a detailed research plan developed in collaboration between the Chinese University advisor of each applicant and the NRC researcher who will co-supervise the applicant;
2. For each post-doctoral fellow applicant, a description of his or her research interests and two (2) recommendations by persons capable of making an informed assessment of the applicant’s research, work and ability;
3. A curriculum vitae and official academic transcripts of the candidate; and
4. A completed Visiting Worker’s agreement prior to commencement of activities.
Implementation plan
December
• CSC announces the program to key Chinese universities and research institutes
December - February 20th – applying to NRC Institutes, Programs, Initiatives and Technology Centers
• Prospective candidates must take the initiative to apply directly to a NRC institute, program, initiatives or technology centers indicating that they intend to seek financial support from MOE-NRC Research and Post-doctroal Fellowship Program. The candidates should be able to meet all of the necessary requirements set by the NRC.
• The proposed supervisor(s) or scientist(s) at the institute, program, initiatives or technology centers of NRC must provide a response letter to the candidate (with a copy to NRC headquarters), confirming that they would be willing and able to host the candidate in their research program/research center as a PhD research student/post-doctoral fellow contingent on candidate’s obtaining a scholarship from the Chinese governments. A drafted template of response letter has been provided as Annex 2.
February 20th – March 20th – applying to CSC
• Applicants holding response letter from a NRC institutes are qualified to apply for the Chinese government scholarship via CSC’s online application system (apply.csc.edu.cn) and should be officially nominated by their home universities and institutions in China.
April-July
• CSC organizes an academic review of the applicants.
May
• CSC will provide NRC an official endorsement letter with an attached list of scholarship nominees of PhD research students.
July
• CSC will provide NRC an official endorsement letter with an attached list of scholarship nominees of Post-doctoral fellows.
September
• CSC will provide logistic support for scholarship holders for their departure to Canada.
• All scholarship holders should fulfill the English/French Language competency as required by the Chinese Government or obtaining certificate letter of language competency in written form from NRC.
